stephanie rothman, san jose state students are dealing with a death of a classmate. this is just a few days into a ne semester. a student was found dead in their dorm room yesterday around one in the afternoon. and it happens in brand new student dorms that just opened this month. kron 4 shock moment has reaction from those students. >>san jose state officials tell us that this death was an isolated instance and that they don't believe that there is any ongoing threat to the public here. but we still did chat with some students here at the smart village on the paseo who tell us that there are a little shaken up as they head into the first couple weeks of the semester. they sent out e-mail. >>america all parents is starting her first year in college at san jose state and she recently moved into the newly designed dorms, spartan village on the paseo. over the weekend, a student was found dead in their dorm. feel sad. >>because although i didn't know the person's by it's like a very sad situation. cent of the state is not revealing

their cause of death is still being withheld at this time. now, san jose state did tell us that they are providing counseling services for students here in the residential dorms as well as faculty who may have been impacted by this death reporting at san jose state jack moment. kron 4 news. >>a 14 year-old boy and a woman are both dead after investigators say a truck driving the wrong way crash into their tesla. it happened shortly before 4 this afn on highway 85 near santa teresa anuin san jose. the chp says a 47 year-old woman was driving a tesla going northbound when the pickup truck crashed into her head on killing her and her teenage passenger. the driver of the pickup identifies as a 39 year-old man from orlando is hospitalized with major injuries. chp says at this time they don't know if drugs or alcohol played a role. all northbound lanes were shut down for about 4 hours during this, but they have since reopened. and police in

berkeley are looking for the driver responsible for sending a child to the hospital. they hit and run crash happening on a crosswalk at dover and alcatraz avenue this morning. officers say a man was pushing the child in a stroller. the man was not hurt, but they do say the child suffered non-life-threatening injuries during this. a swimming instructor accused of molesting children is trying to get out of jail. his lawyer says his dietary restrictions are not being met. 25 year-old tyler livingston has been asked santa rita jail in joplin since his arrest last month, according to his lawyer, he's been served milk and eggs despite being locked host, intolerant and vegetarian. his lawyer argues prison kitchen staff headed north. the letters asking for different food and now requesting he be released to his parents home equipped with a gps device. legal experts say this is a long shot at getting him out. >>will the state where his parents live accept as safe. sure. we'll take your child

even by a former president united states. and he's also charged with obstructing the investigation into that claim by ordering his employees to hide the box is the documents we've all seen the pictures of these boxes of documents mar-a-lago ordering people to hide the men, not tell the truth about whether they seen them or move them. that center. that case was criminally charged by the special prosecutor appointed by the attorney general to investigate various things about donald trump. and that case was that dismissed by the trump appointed district court judge in florida. who the appointment of the prosecutor was unconstitutional. in other words, not questioning the merits of the case where they're classified documents that were headed by the president in florida was instructional justice. no ruling on the merits simply saying the appointment of prosecutor was unconstitutional. she dismissed the case and the special prosecutor has now

appealed that to the 11th circuit, the circuit, the federal circuit that sees florida and other southern states. it'll take months for that appeal to be resolved. it will almost certainly be resolve against trump. he will lose that appeal. they will then take appeal from that to the supreme court. and we know there's one vote for trump at the court because justice thomas says the special prosecutor was also unconstitutionally appointed and there may be other boats, but whether it's a majority, if the supreme court. but another, we're talking about months and probably years before this comes back and then this judge is likely to dismiss it again because she clearly is completely against this prosecution of this case. >>so, professor little, i mean, all the legal wranglings notwithstanding. people would like to you know, justice served. and will that ever happen?

>>you know, you're absolutely right. it is indictment of our justice system that when you have video evidence of these documents being hidden in marlow lot, mar-a-lago and testimony from the employees who say trump told to lie about it. so you have obstructed justice. you have this evidence. so clearly on point and yet months and months and months can go by. it really is an indictment of the system and there's no reason for anyone to have the faith in our federal system that they used to have, which is terrible for me to say as a former federal prosecutor and also a former 30 years, not former or current professor at u c a loss after cisco. >>it's so is it correct that this could change the role that special prosecutors play in years to come cases to come. and also what about the

idea of just having the justice department try the case without a special prosecutor. fine. if the judge doesn't like the special prosecutor, we could just, you know, do this the quote, unquote, normal way. >>you know, i think that's a really good point. and i think many people within the department of justice were advocating, hey, attorney general, what you just switch, the prosecutor just take the special prosecutor out and put into career prosecutor who can handle the case. i don't know why that wasn't done. i think it was a viable solution. it wasn't done. >>i think this administration simply wants to make the point that this argument that special prosecutor unconstitional is wrong as a matter of constitutional law if it were to be upheld us, it would change that would say you can't have special prosecutors. you have to have sort of career appointed prosecutors. the distinction between those 2 things i think

>>county transit officials say all bus driver showed up for work today after a scheduled quote, calling sick day was bland as officials continue to negotiate with the union. for the last few months. samtrans and union officials have been trying to negotiate a new contract. the most recent offer from the agency being rejected by the union on august 14th. >>samtrans officials tell us the offer was fair competitive, an equitable and offered a wage increase of 4%. this fiscal year and a 3.5% over the next 2 fiscal years and also offered a targeted equity adjustment for both operators and maintenance workers. no word on why the offer was rejected. but the agency says in response they were expecting multiple call outs both on monday and tuesday from about 400 of the bus drivers that are represented by the union with the agency saying bus driver showed up for work and they don't expect any call offs tomorrow either. as we get more details regarding those negotiations will continue to keep you updated. that's the very latest here in millbrae very latest here in millbrae michael th

here's the good news. they say they collected and taken away all of them. but they want to warn the public before more could pop up. >>so this is the qr code here. so this is a sticker that actually took out of evidence. one of the ones that was actually recovered over the weekend and it looks legitimate. and if you look at what is on the parking meters, there is a smaller version of a qr code for one of the ops. and i could see how this sticker being placed on the parking meter would be misleading. >>now we want to show you images of the fake ones. they're much larger than the real ones. and when scanning these fake stickers users are taken to a website labeled ploy by phone and asked to put in their payment info. now the official website is called pay by foreign phone. not point but pay. now what we also want to show you, the real companies working with redondo beach to collect parking fees. there are 2 official ones. the first is park mobile and the second pay by phone park mobile uses a qr code that directs users to their official app. pay by phone accepts payments on their app or on their official website.
